Public-site terms only. Paid subscriptions, authenticated reviewer portals, and signed customer agreements can impose separate or superseding terms.

These Website Terms of Use (these “Site Terms”) govern access to and use of the Aurora Command websites, public pages, public or gated downloadable materials, public Trust Center pages, procurement request pages, demo-request pages, and other public or marketing-facing online properties made available by Borealis Security, Inc., doing business as Aurora Command (“Borealis,” “Aurora Command,” “we,” “us,” or “our”).

These Site Terms apply only to public-site and visitor use. They do not replace the Aurora Command Self-Service Subscription Terms, any customer agreement, any order form, any clickwrapped account terms, or any signed written agreement that specifically governs a paid workspace, paid services, or a reviewer portal provided at a customer’s direction.
If you create an account, purchase a subscription, enter a portal behind an acceptance screen, or otherwise assent to separate terms, those separate terms control to the extent of any conflict. If a customer invites you into a customer-controlled reviewer portal, the customer and Borealis may impose additional terms, confidentiality restrictions, or access conditions.

2. Eligibility; Acceptance

By accessing or using the website, you acknowledge that you have read and understood these Site Terms and agree to be bound by them to the maximum extent permitted by applicable law. If you do not agree, do not use the website.
You may use the website only if you are legally capable of forming a binding contract and, where you act on behalf of an entity, you are authorized to act for that entity. The website is intended primarily for business and professional use, not for personal, family, or household use.

3. Limited License

Subject to these Site Terms, Borealis grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the website solely for lawful internal evaluation of Borealis and its offerings.
No right is granted to copy, reproduce, frame, mirror, republish, sell, exploit, create derivative works from, or distribute the website or its content except as expressly permitted in writing by Borealis.

4. Prohibited Conduct

  • Using the website or any downloadable materials for unlawful, deceptive, infringing, defamatory, harassing, or abusive purposes.
  • Scraping, crawling, harvesting, indexing, or otherwise extracting content, metadata, or usage data by automated means except by a public search engine acting in accordance with the website’s technical controls and Borealis’s permissions.
  • Reverse engineering, decompiling, probing, or attempting to discover source code, non-public APIs, security controls, or system architecture.
  • Attempting to bypass authentication, rate limits, robots directives, access restrictions, file protections, watermarking, or link-expiration controls.
  • Conducting vulnerability scanning, penetration testing, load testing, or other security testing without Borealis’s prior written authorization and an agreed scope.
  • Using the website, public materials, or reviewer materials to build or train a competing database, questionnaire engine, template library, trust-center service, AI retrieval corpus, or competing product.
  • Removing proprietary notices, confidentiality notices, legends, or attribution marks.
  • Impersonating another person or entity, misrepresenting affiliation, or submitting false, misleading, or incomplete information through forms or requests.

5. Trust Center, Reviewer, and Downloaded Materials

Some materials made available through trust, procurement, or reviewer pages are confidential, customer-specific, restricted, or made available solely for evaluation of Borealis or a Borealis customer. You may use those materials only for the specific evaluation purpose for which access was granted.
You must not redistribute, republish, publicize, benchmark, commercially exploit, or disclose restricted materials except as expressly permitted by the applicable access notice, confidentiality obligation, or written authorization. Borealis may watermark, log, monitor, revoke, or time-limit access to such materials.

6. Intellectual Property; Trademarks; Feedback

Borealis and its licensors own all right, title, and interest in and to the website, its design, text, graphics, logos, software, downloads, libraries, videos, documents, and all related intellectual property rights. Aurora Command and related marks are Borealis trademarks or trade names.
If you provide comments, ideas, or feedback, you grant Borealis a perpetual, irrevocable, worldwide, royalty-free, sublicensable right to use and exploit that feedback without restriction or obligation.

7. No Professional Advice; Informational Nature of the Website

The website and public materials are provided for general informational purposes only. They are not legal advice, audit advice, compliance certification, insurance advice, security guarantees, or a promise that any customer will achieve any particular outcome.
Any statements about features, roadmap, integrations, response times, support, or security are illustrative and subject to change unless Borealis expressly commits otherwise in a separate written agreement.

8. Third-Party Sites and Services

The website may link to third-party websites, repositories, calendars, video services, forms, analytics providers, or other services. Borealis does not control and is not responsible for third-party content, practices, or terms.

9. Disclaimers

THE WEBSITE, ALL CONTENT, ALL DOWNLOADS, ALL DEMOS, ALL TRUST MATERIALS, AND ALL RELATED INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOREALIS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, OR RESULTS.
BOREALIS DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL REMAIN AVAILABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOREALIS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR SUBSTITUTE PROCUREMENT COSTS, ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE SITE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF BOREALIS AND ITS AFFILIATES ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE SITE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

11. Indemnity

You will defend, indemnify, and hold harmless Borealis and its affiliates and their respective officers, directors, employees, contractors, successors, and assigns from and against claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Site Terms, misuse of the website, or violation of law or third-party rights.

12. Suspension; Changes; Termination

Borealis may modify, suspend, restrict, or discontinue all or any part of the website at any time, with or without notice.
Borealis may suspend or block your access immediately if Borealis reasonably believes you violated these Site Terms, pose a security risk, or are using the website in an unauthorized or harmful manner.
Borealis may update these Site Terms prospectively by posting an updated version on the website. Continued use after the effective date of updated Site Terms constitutes acceptance of the updated Site Terms to the maximum extent permitted by law.

13. Governing Law; Venue; Jury Waiver

These Site Terms and any non-arbitrated dispute arising out of or related to the website are governed by the laws of the State of Alaska and, to the extent applicable, the Federal Arbitration Act, without regard to conflict-of-law rules.
Any action or proceeding not subject to a separate arbitration agreement must be brought exclusively in the state or federal courts located in Anchorage, Alaska, and each party irrevocably submits to those courts’ personal jurisdiction and venue.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE SITE TERMS.

14. Miscellaneous

  • These Site Terms are the entire agreement between you and Borealis regarding the website where no separate governing agreement applies.
  • If any provision is unenforceable, the remaining provisions remain in effect.
  • Borealis may assign these Site Terms freely. You may not assign them without Borealis’s prior written consent.
  • No waiver is effective unless in writing and signed by Borealis.
  • Nothing in these Site Terms creates an agency, partnership, fiduciary, employment, or joint-venture relationship.
  • No Third-Party Beneficiaries. These Site Terms are solely for the benefit of Borealis and the individual or entity using the website. No reviewer, prospect, customer, referral recipient, insurer, auditor, regulator, or other third party is an intended beneficiary of these Site Terms.

General support, security, and privacy contacts may also be listed on the website, but customer support communications do not by themselves constitute formal legal notice unless Borealis expressly states otherwise.

Self-service checkout binds purchasers to the Aurora Command Self-Service Subscription Terms, not these website-only visitor terms.
